Moto Marketing General Conditions of Sale for the use of the site www.moto-marketing.ch

Article 1 Scope

The purpose of these general conditions of sale is to govern the relations between:

• the company Moto Marketing SA, Nonceruz 4, 2732 Reconvilier, editor of the site www.moto-marketing.ch
• the Internet user or the reseller having accepted the general conditions by becoming a member of www.moto-marketing.ch hereinafter referred to as the customer.

Article 2 Products

2.1 The products sold are described on the website www.moto-marketing.ch at the time of the sale. The characteristics of the products as well as the photos are established in agreement with the supplier and are given only as an indication.

2.2 The products are available on the site depending on available stocks.

Article 3 Price; participation in delivery costs

3.1 The prices are understood to be net, in Swiss francs, including VAT; they are applied for the duration of the publication but can be changed without notice.

3.2 To the prices indicated are added the delivery costs appearing in the "basket" section of the order form.

Article 4 Conclusion of the sale; payment ; confidentiality

4.1 The photos in our online product catalog are not contractual. By clicking on "Confirm my order" you give your consent to order the items selected in your basket. The sales contract comes into force upon receipt of the order confirmation email.

4.2 The price of purchases made on the site www.moto-marketing.ch is due at the time of the order, without discount; payment is made by MasterCard, VISA, American Express, PayPal (Visa, MasterCard, American Express, Aurore, Cofinoga, 4 stars) or PostFinance Card.

4.3 Moto Marketing does not have access to confidential information relating to the means of payment. The information entered is encrypted and transmitted to SIX Payment in a secure manner without Moto Marketing or third parties having access to it.

4.4 You have the option of concluding your sales contract in French or German.

4.5 This order confirmation constitutes an acknowledgment of debt within the meaning of art. 82 LP.

Article 5 Delivery

5.1 The products are sent to the delivery address indicated by the customer during the ordering process.

5.2 Moto Marketing delivers to the following countries: Switzerland and Liechtenstein.

5.3 The shipping costs for delivery to Switzerland or Liechtenstein amount to CHF 9.90 to CHF 15.90 depending on the weight and size of the package. The COD shipping costs amount to CHF 19.90 to CHF 29.90. The maximum weight is 30 kg.

5.4 Unless special conditions are specified at the time of validation of the order, the delivery time is generally 24 to 48 hours.

5.5 Moto Marketing undertakes to inform the customer of any delay in delivery. It cannot be held liable for any compensation under this head.

5.6 The amount of delivery costs is indicated in the "basket" section and is subject to the approval of the customer before the validation of each order.

Article 6 Guarantee in the event of defects; right of return

6.1 If the product has defects, Moto Marketing's guarantee is limited to the return of the product and the reimbursement of the price, subject to the respect, by the customer, of the conditions and deadlines indicated in the following paragraph.

6.2 Regardless of the existence of a defect, the customer may, unless stated "cannot be returned", at his own expense, return his order within 7 working days from the date of receipt, provided that you have previously, within 2 working days, requested a return number by email to info@moto-marketing.ch by following the procedures appearing in the "contact" section of the site www.moto- marketing.ch.

6.3 In the event of a return in accordance with paragraphs 6.1 and 6.2 above, the price paid will be refunded as follows:

• If the return is due to a Moto-Marketing error in the delivery, we will refund the amount of the value of the goods with the postage costs to the credit of the customer's card.
• If the Merchandise has been returned within 7 working days, we will refund the amount of the merchandise without postage to the credit of the customer's card.

Article 7 Conditions of use of the site

7.1 The use of the site www.moto-marketing.ch is authorized for private and professional use.

Article 8 Data protection

8.1 For the use of customer data, Moto Marketing complies with the legislation in force, in particular the law on data protection. Moto Marketing only processes and stores the data necessary for the proper performance of its services and the invoicing thereof.

8.2 The customer accepts that Moto Marketing uses his data for the design and development of its services for him and for the development of tailor-made offers concerning him.

Article 9 Modification of the general conditions

9.1 These general conditions may be modified at any time by Moto Marketing.

9.2 It is the customers' responsibility to keep themselves regularly informed of the content and possible modifications of these general conditions.

Article 10 Applicable law and place of jurisdiction

10.1 The relations between Moto Marketing and the customer are governed by Swiss law.

10.2 For any dispute relating to the relationship between Moto Marketing and the customer, the place of jurisdiction is the headquarters of Moto Marketing.
